Terms of Use

These Terms of Use govern the use of the TrichoScan FAST online portal provided by Datinf GmbH by professional users. The Paddle buyer terms and refund information presented during checkout also apply to the purchase and billing of the subscription.

2. Professional use only

The service is intended exclusively for professional users acting in the course of self-employed, commercial, professional or institutional activities. Private use is excluded. The person subscribing confirms that they are authorized to enter into the subscription for themselves or the organization stated.

3. Contract and payment processing through Paddle

The subscription is purchased and billed through Paddle, which acts toward the buyer as authorized reseller and merchant of record. The Paddle terms presented at checkout apply to purchase, payment, taxes, invoicing, renewal, cancellation and refunds. Portal access is activated after successful payment confirmation. These terms additionally apply to use of the portal.

4. Service description

The portal enables professional users to upload standardized close-up scalp images, have them analyzed automatically and quantitatively, view the measured visible hair parameters and annotated result images, and export a PDF report. Measurements include in particular hair density, hair thickness, follicular units and ostia. The subscription costs €120 net per month plus applicable taxes. Each uploaded image and its result remain available in the portal for 30 days from upload.

5. Cosmetic purpose and limitations

TrichoScan FAST AI Online is intended solely for standardized quantitative measurement and documentation of externally visible hair characteristics for cosmetic purposes. The software is not intended to detect, diagnose, monitor, predict, treat or alleviate diseases or pathological conditions and does not provide medical recommendations. The service must not be offered, marketed or used as a medical or diagnostic service. Results must not be used as a basis for diagnoses, medical decisions, medication decisions or treatment recommendations. The system does not make decisions about individuals or assign health, risk or eligibility categories.

6. User account

Each user account is associated with an email address used for professional purposes. Login credentials must not be shared with unauthorized persons. Professional users must use secure credentials and notify Datinf without undue delay of suspected unauthorized access. Actions performed through an account are attributed to the professional user or associated organization to the extent they are responsible for the misuse.

7. Obligations of professional users

A professional user may transmit only images and other information they are authorized to use and process. The professional user is responsible for properly informing depicted persons about capture and processing and for ensuring the required legal basis. File names, comments and internal references must not contain names, dates of birth, diagnoses, medication or treatment information, or other unnecessary identifying or medical information. Images should be framed so that faces and other directly identifying features are not visible wherever possible. The service must not be misused; in particular, security mechanisms must not be bypassed, malware must not be transmitted and third-party rights must not be infringed.

8. Image quality and results

Results are generated automatically from the uploaded image. They depend in particular on framing, image scale, device and attachment, focus, lighting, preparation of the image area and positioning. Datinf may reject technically unsuitable images or mark them as not analyzable. Professional users must review results for plausibility before further use. Comparisons between images are meaningful only under standardized and sufficiently comparable image-capture conditions.

9. Subscription, price, term and cancellation

The subscription costs €120 net per month plus applicable taxes. It renews automatically for successive one-month periods until cancelled. Cancellation is made through the Paddle customer portal or another cancellation method provided by Paddle and generally takes effect at the end of the current billing period. Access remains available until then, subject to successful payment and compliance with these terms. Access may be restricted or suspended if payment fails or is charged back.

10. Fair Use

TrichoScan FAST subscriptions are intended for normal professional use at a single registered business location.

The subscription includes unlimited analyses subject to fair use. Normal professional use currently means up to 150 successfully completed analyses per billing month and location.

Only analyses that result in a successfully generated analysis report count toward this threshold. Failed analyses, technically unsuccessful processing attempts, or repeat uploads required because an image is unsuitable do not count as completed analyses.

Exceeding the fair-use threshold does not automatically result in additional charges or suspension of the service. If usage substantially exceeds the fair-use level on a recurring basis, we may contact the customer to discuss a suitable high-volume or enterprise plan.

Automated bulk processing, resale of analysis services, account sharing between separate business locations, or other use substantially outside normal professional use is not covered by the subscription.

11. Availability, maintenance and support

Datinf aims to operate the portal reliably and securely. Temporary limitations may result in particular from maintenance, security measures, technical faults, updates or outages of service providers. Continuous uninterrupted availability is not guaranteed unless a separate service agreement expressly provides otherwise. Support is available through the channels listed on the contact page.

12. Availability, export and deletion of data

Uploaded images and associated result data remain available in the portal for 30 days from upload. At the end of this period they are deleted automatically and can no longer be accessed. The portal is not a permanent archive. Professional users are responsible for downloading and securely retaining any required reports within the availability period.

13. Data protection and processing on behalf

Where Datinf processes personal images and result data on behalf of a professional user, processing is governed by a separate data processing agreement where required. The user remains responsible for the purpose, lawfulness of data collection and information provided to the individuals concerned. Further details are set out in the privacy policy.

14. Confidentiality

Both parties will keep confidential non-public business and technical information learned in connection with use of the service. Datinf limits access to professional-user data and data relating to people shown in uploaded images to persons and service providers who require access to provide, secure or support the service.

15. Intellectual property

The software, user interface, documentation, trademarks, texts, graphics and other portal components are legally protected and remain with Datinf or their respective rights holders. Professional users retain their rights in submitted content and grant Datinf the rights required for the duration and purpose of contract performance to store and technically process images, transmit them to contracted analysis systems and generate the requested results.

16. Liability

Datinf is liable without limitation for intent and gross negligence, for culpable injury to life, body or health, and where liability is mandatory by law. For slight negligence in the breach of an essential contractual obligation, liability is limited to foreseeable damage typical for the contract at the time of contract formation. Liability for other cases of slight negligence is excluded. Professional users are responsible for saving required reports and data within the availability period.

17. Changes to the service and terms

Datinf may further develop and change the service technically or visually provided that the agreed core service is not unreasonably restricted. Material changes will be announced with reasonable notice through the portal or by email. Changes to these Terms of Use do not apply retroactively to completed billing periods. Where consent is required, it will be requested separately.

18. Governing law and venue

The laws of the Federal Republic of Germany apply, excluding the United Nations Convention on Contracts for the International Sale of Goods. To the extent legally permitted, Tübingen is the venue for disputes arising from or in connection with the contract.
